Abstract

Family is accorded profound importance in Islam and marriage is referred to as a solemn covenant. Islamic law directs the spouses to live contentedly with respect and affection for possible maximization of the matrimonial bond. It gives the Right to the dissolution of marriage to both spouses. Muslim Women have numerous remedies to protect their rights in case of harm (darar). Islamic injunctions denote an efficient process for it that protects the rights of spouses, children, and society at large. These instructions are the grounds of the family laws of Pakistan with some inconsistencies. Blatant violation of Islamic norms in Pakistan is due to public ignorance of Islamic values and weak implementation of laws. The paper in hand will examine the various ways and grounds of dissolution of marriage in Sharia’h and Pakistani Law. It will highlight the rights of women in Islamic and Pakistani Laws of dissolutions of marriage. This research will explore the gaps in Pakistani laws and provide recommendations for effective legislation. It will minutely result analysis of Dissolution of Muslim Marriage Act 1939 in Sharia’h and legal perspective. It will facilitate to establish of contented matrimonial life and pleased society.
